Questions

What health IT suppliers ask first

Short answers, each with the article it rests on.

Is a health software supplier under NIS2?

Usually through its clients: the hospital is, and Article 21 has it manage your security as its supplier. It can be yours too, as a maker of medical device software or as a cloud provider, from medium-sized up.

Art 21(2)(d)Annex II, 5(a)
Does the CRA apply to clinical software?

Not if it is a medical device under the MDR, which Article 2(2) excludes. Other health software you place on the market is in the CRA like any product.

CRA Art 2(2)
Is our AI feature high-risk?

It is if it is a medical device, or a safety component of one, that needs a notified body under the MDR, from 2 August 2028. Some Annex III uses, emergency patient triage among them, are high-risk too.

AI Act Art 6(1)AI Act Annex III, 5(d)
What will a hospital ask us under NIS2?

Its measures must cover the security of each direct supplier, weighing your vulnerabilities, product quality and secure development, so expect questions on all three.

Art 21(2)(d)Art 21(3)
Do we need a processor contract with each hospital?

Yes, where you process patient data on its behalf. Article 28(3) sets what the contract must contain, and health data is a special category under Article 9.
