The CRA's 24-hour reporting duty has applied since 11 September 2026. Check whether it reaches you

Directive (EU) 2023/1791 and Delegated Regulation (EU) 2024/1364

Energy Efficiency Directive: who owes the audit, and when

Read from the Official Journal, the Commission's register and two national acts on 18 October 2026.

Above 10 TJ a year an enterprise owes an energy audit, and above 85 TJ a certified energy management system, both on its own state's terms and dates. A data centre from 500 kW reports every year, directly.

Does Article 11 reach your company?

Six questions, answered in your browser. Nothing is sent or stored.

Where is the enterprise established?

Your state's law carries Article 11. We have read Germany's and Denmark's acts in full.

Average yearly energy use over the last three years

All energy carriers together: electricity, gas, fuel and heat.

A certified energy management system in place?

ISO 50001, or another system certified by an independent body.

A certified environmental management system?

Article 11(11) is about this system, not the energy one.

A data centre with at least 500 kW of installed IT power?

Owned or operated, for your own use or for customers.

Your answer

Start with your energy use

It decides whether Article 11 reaches you at all.

Start the ISO 14001 system

One answer above is still open: Where is the enterprise established?. The record states every answer, so the offer appears as soon as it is given (€29).

The determination on its own page

Who it applies to
Enterprises using more than 10 TJ of energy a year, averaged over three years with every carrier counted, and data centres from 500 kW of installed IT power.
The dates
On your state's dates. 11 October 2026 for the first audit and 11 October 2027 for the management system are only the latest a state may set.
The one thing to do
Answer the six questions below. A certified ISO 14001 or EMAS system that includes an Annex VI energy audit is exempt under Article 11(11).

The act that carries Article 11, in all 27 states

Every state has notified measures for this Directive, 864 of them. We name the one that carries Article 11 in 9 states; in the other 18 the state's law governs and we have not yet named the act.

Whatever your state has done, Delegated Regulation (EU) 2024/1364 binds a data centre from 500 kW directly: a report to the European database by 15 May every year.

Questions

Who must do an energy audit under the Energy Efficiency Directive?

An enterprise above 10 TJ of energy a year, averaged over three years with every carrier counted, that has no certified energy management system. The Directive draws no SME line; your state's law decides the rest.

Is ISO 50001 mandatory?

Above 85 TJ a year your state's law must require a certified energy management system. The Directive names no standard, and ISO 50001 is the usual one.

Does ISO 14001 exempt us from the energy audit?

Under Article 11(11), only if the certified system includes an energy audit meeting Annex VI. Germany's EDL-G names EMAS and not ISO 14001; Denmark accepts it with an energy review.

Do data centres have to report?

Yes, from 500 kW of installed IT power. Delegated Regulation (EU) 2024/1364 applies directly: a report to the European database by 15 May every year, for the previous calendar year.

When is the deadline?

Your state's date. 11 October 2026 for the first audit and 11 October 2027 for the management system are the latest a state may set. Denmark set 1 August 2025 and 1 August 2026; Germany required the system by 18 July 2025.

How we read it

A directive binds the member states, so your own state's act is the one that binds you. We read the Directive and the delegated regulation from the Official Journal, the 864 notified measures from the Commission's register, and two national acts in full.

If you already run ISO 14001, the Annex VI energy audit is the piece that turns your certificate into the Article 11(11) exemption. ISO 14001 in StandardOS
