Regulation (EC) No 1907/2006
REACH for products: what do you owe for what is inside?
- Who it applies to
- Every company that makes, imports or sells finished products in the EU, which REACH calls articles, whatever the product is.
- The dates
- Now. A substance the Agency adds to the Candidate List brings Article 33 at once and the notification within six months.
- The one thing to do
- Tell business customers about Candidate List substances above 0.1 %, answer a consumer within 45 days, notify the Agency above a tonne a year, and meet Annex XVII.
Three answers give the REACH duties that reach you as a supplier of articles.

The Candidate List
1. The procedure set out in paragraphs 2 to 10 of this Article shall apply for the purpose of identifying substances meeting the criteria referred to in Article 57 and establishing a candidate list for eventual inclusion in Annex XIV. The Agency shall indicate, within this list, the substances that are on its work programme according to Article 83(3)(e).
10. The Agency shall publish and update the list referred to in paragraph 1 on its website without delay after a decision on inclusion of a substance has been taken.
The list itself is the Agency's, and a substance can join it at any time, so this page links it rather than copying it. The Candidate List, on the Agency's website
A regulation, enforced nationally
REACH applies directly in every Member State, with no national law in between. Article 126 leaves the penalties to each Member State, so enforcement and fines differ from country to country.

Questions people ask
- Is my product an article or a mixture?
- Article 3(3): an article is an object whose shape, surface or design decides its function more than its chemistry does. A pen is an article and its ink a mixture; an article meant to release a substance brings Article 7(1).
- What does above 0.1 % weight by weight mean?
- The concentration of the Candidate List substance in the article, as Article 33 counts it. Article 7(2) adds a second test for producers and importers: over one tonne a year across their articles.
- How fast must we answer a consumer?
- Within 45 days of the request and free of charge, Article 33(2). You give the information you have that allows the article to be used safely, at least the name of the substance.
- Who publishes the Candidate List, and when does a change bind us?
- The European Chemicals Agency publishes and updates it on its website, Article 59(10). A substance added there brings Article 33 at once and the Article 7(2) notification six months later, Article 7(7).
- Our products are electronics. Is RoHS not enough?
- No. RoHS limits 10 substances in electrical and electronic equipment; REACH's Article 33 covers every Candidate List substance in any article, and Annex XVII restricts further uses. One product carries both.
Keep the substance answers and the reviews in one place
StandardOS holds your REACH duties and the evidence for each. It schedules a review against the Candidate List every six months and a yearly Annex XVII check, next to the other frameworks you run.
